Legal Action

A Representative Action is a type of collective action, where a Representative Claimant brings a claim on behalf of a group of people with a shared grievance or interest (similar to a class action, though not the same). This means that members of the class can have their claims determined by the Court without each member having to bring their own individual claim. It offers the most efficient and cost-effective route to a Court decision, with the least possible delays. The procedure is set out in Civil Procedure Rule (CPR) 19.8.

Secret Commissions
A large number of IP law firms (13 in the UK alone, excluding Marks & Clerk LLP) have been referring clients to CPA Global and there is evidence that they have received payments in return. A recent decision from the Supreme Court of England & Wales has confirmed that, in this situation, the client must give fully informed consent to that payment, otherwise it is deemed a secret commission. Only one such firm has, only recently, disclosed what they are paid (£160 per renewal). That same decision confirmed that the payer, in this case CPA Global, is the primary wrongdoer. CPA Global’s renewal charges are deemed to have been inflated by the amount of the payment.

In late 2017, CPA Global changed its terms and conditions of supply (attached to every Renewal Notice) so that any dispute involving a client based in Europe is to be decided by the Laws and Courts of England & Wales.
